GENERAL CONDITIONS [version of June 8, 2021]
1. DEFINITIONS
- BIG SACK: This brand name designates the company BSC Transports SA, located at Route de Puidoux 16, in Grandvaux (VD) in Switzerland.
- BIG BAG / Bag: The term "BIG BAG" or "Bag" refers to the waste bags sold by BIG SACK to its Customers.
- Collection / collection: This is the collection and disposal of the BIG BAG by BIG SACK. • Logistic partner: BIG SACK can call upon logistic partners for the collection of bags.
- Customer: Anyone purchasing a BIG BAG or ordering a pickup from BIG SACK is considered a Customer.
2. GENERAL
2.1. Any quotation or price estimate given by BIG SACK is indicative only and only becomes binding if confirmed in writing by BIG SACK. Prices quoted are based on information available at the date of the quote or estimate, and BIG SACK reserves the right to change prices at any time without notice before accepting a customer order or not, even if has already been paid. Likewise, the dimensions of the BIG BAGS are approximate and are provided for information only.
2.2. All transactions with BIG SACK are governed by these Terms and Conditions, which shall apply to the exclusion of any other terms. By placing an order or requesting a pick-up/collection, you acknowledge that you have read, understood and accepted, without reservation, these General Conditions.
2.3. BIG SACK cannot be held responsible for delays or other failures if these are the result of a case of force majeure, either of a circumstance beyond the reasonable control of BIG SACK or which is neither foreseeable. , nor objectively attributable to BIG SACK. In case of delay resulting from force majeure, BIG SACK will fulfill its obligations as soon as possible.
3. PLACEMENT OF BIG BAGS ON PUBLIC ROADS
3.1. It is generally necessary to obtain municipal, cantonal or federal authorization to store a BIG BAG or a dumpster on the public highway. If you do not have a valid permit, your BIG BAG may be removed before you have filled it and/or you may be fined. Fines of this type are entirely the responsibility of the Client. It is the Customer's responsibility to find out about any authorizations and to take the necessary steps with the competent authority. In principle, it is not necessary to have a permit if you place a BIG BAG on private land, such as a driveway or garden. In addition to the costs related to authorizations, if a BIG BAG must be placed in a paid parking space (parking meter, controlled parking areas, etc.), the Customer must take charge of all the steps for the suspension of parking and pay all the costs relating thereto with the competent authority. Similarly, if a BIG BAG is stored in a private parking space (visitor space or allocated space), the Customer is responsible for obtaining authorization from the owner or management, and pays any costs relating thereto.
4. DELIVERY OF BIG BAGS
We send our BIG BAG the working day following the day of the order. All our BIG BAGS are sent by Swiss Post. We do not guarantee any delivery time, but we do our best to get your order to you as soon as possible.
We only ship our BIG BAGS within Switzerland. BIG BAGS ordered after Christmas Eve at noon will be dispatched on January 4, 2021.
5. USE AND STORAGE
Although our BIG BAGS are strong, they can be weakened if not stored or used with care. Check your bag after unpacking it and notify us immediately if you identify any faults. Avoid puncturing or tearing the BIG BAG during use. Do not use the bag to throw sharp objects, hot ashes or anything that could damage it. Our BIG BAGS are single use and will not be replaced.
6. POSITIONING THE BAG
Position the bag where it will be picked up by our truck before starting to fill it. You may not be able to move it afterwards. In addition, moving the BIG BAG may cause you to damage the bag or injure yourself.
When using your BIG BAG, please position it less than 4 meters from the public road. Said public road must be at least 4 meters wide and must be easily accessible for a truck. Please also note that our trucks do not drive on cobblestones due to the risk of damage to public roads.
Keep in mind that the collection of your BIG BAG will be carried out by a large truck. The vehicle that will pick up your bag can easily exceed the size of a fire truck. If you have any doubts about the accessibility of your BIG BAG, please contact us to discuss before ordering your pickup. Additional costs may be charged if the collection fails due to difficult access, or if we have to use small vehicles to evacuate your BIG BAG.
The bag must also be kept away from walls, trees, parked cars, power lines (in particular those of trams or trolleybuses) and any other element likely to interfere with the collection of your BIG BAG by means of a crane or mechanical arm.
Please do not place your BIG BAG on public roads or pavements without first obtaining permission from your local authority.
The Customer will also ensure that the BIG BAG is stored away from the rain to prevent it from filling with water in the event of bad weather.
7. FILLING THE BIG BAG
Evenly distribute your waste and its weight in the bag. Do not overload the bag or fill it above the top edge. Our large BIG BAG can hold a maximum of 1.5 tons, and our small BIG BAG is limited to 1 ton. If the bag is overfilled, you will be charged extra. If in doubt, please contact us before purchasing your bag or ordering your pickup.
Remark : our BIG BAGs are intended for the disposal of garden waste and construction site waste only. The bag should not be used to dispose of hazardous or special waste. Examples of hazardous or special waste include asbestos, refrigerators, freezers, batteries, electrical appliances, gas cylinders, liquids, chemicals, spring mattresses, and clinical or food waste. These wastes are more expensive to recycle or dispose of. If we find any of this waste in your bag, you will be charged extra. You should also be aware that if you do not declare this waste or do not comply with these guidelines, you risk violating Swiss environmental protection laws. If in doubt, please contact us before purchasing your bag or beginning filling.
Also note that plasterboard cannot be accepted if mixed with other waste. Please therefore store any plasterboard in a separate bag dedicated solely to this type of waste. We will only collect the plasterboards if they are separated in their own BIG BAG.
8. COLLECTION OF YOUR BIG BAG
The collection of your BIG BAG can be ordered either directly on our website www.bigsack.ch, or by telephone. The collection can be carried out independently by our own trucks or by a logistics partner. When ordering, please let us know exactly where your BIG BAG is so that it can be easily found by our driver or our logistics partners. Please also let us know the number of BIG BAG to be picked up and ensure that the road is wide enough for our collection truck (at least 4 meters), if there may be any obstacle or other problem, and if you must be present during collection.
We do not undertake to collect your BIG BAGS when you purchase our bags. When ordering a pickup, we reserve the right to refund your order without justification within 7 days. It may indeed happen that we are not able to collect your bag, especially if the collection point is too far away.
We strive to collect your bag within 15 working days, starting the day after your request. However, this time frame cannot be guaranteed and may be extended, but we will always keep you informed.
Please note that the collection price will be confirmed to you over the phone. Price variations may apply in certain areas (e.g. for postcodes). If you are unsure of your location, please contact us before purchasing the bag or your pickup, and we can confirm the price of the pickup.
9. ACCESSIBILITY
Please ensure that our driver or logistics partner can access the BIG BAG anytime between 6am and 9pm, seven days a week, even if no one is there. Please note that we reserve the right to refuse collection if a bag is placed out of reach of our vehicle or our logistics partner's vehicle. We also reserve the right to refuse collection if the truck has to roll on a pavement, if the operation of the crane is obstructed, if
our driver or our partner cannot access the site, or if the bag is overloaded, overfilled, damaged or contains anything other than ordinary garden or construction waste (see "Filling the BIG BAG" above).
Please inform the staff at the time of booking the collection of any restrictions that may apply to the collection site, eg no parking, no waiting, etc.
If collection is not successful for any of these reasons, you may not be able to get a full refund. The mere movement of our trucks or our logistics partners to your collection site induces non-negligible costs.
10. REFUND POLICY
We hope you won't change your mind, but should you do, you have up to 28 days to return your BIG BAG and request a refund. Simply contact our customer service team and return your unused, folded BIG BAG to us in the same manner as when you received it. Please note that the cost of returning the BIG BAG will be at your expense. Upon receipt, we will refund you in full.
As for pick-up orders, these can only be canceled up to 5 working days before the pick-up date communicated to you, and a maximum of 2 working days after your order.
11. LIMITATION OF LIABILITY
11.1. To the fullest extent of applicable law, BIG SACK cannot be held liable for any loss or damage to customer property. In any event, BIG SACK is not liable to the Customer for indirect losses (including loss of profits and/or damage to goodwill), economic losses and/or other similar losses, special damages and other direct and indirect losses or from business interruption, loss of business or loss of opportunity.
11.2. The Customer agrees to do its best to remedy any problem or dispute that may involve BIG SACK, and does not incur any costs potentially attributable to BIG SACK without prior written authorization from BIG SACK. Otherwise, all costs will be charged to the Customer.
11.3. BIG SACK shall have no liability to the Customer if the sums owed by the Customer have not been paid in full by the payment due date.
11.5 BIG SACK endeavors to ensure that equipment arrives when the customer requests delivery, and also does its best to ensure that collection dates are met. Approximate times given by BIG SACK are estimates only and BIG SACK cannot be held responsible for any delays, however caused.
12. EQUIPMENT RISK
12.1. The risk related to the material (in particular the BIG BAGS), is transferred immediately to the Customer when the material leaves the physical possession or control of BIG SACK.
13. DATA PROTECTION
13.1. The processing of personal data by BIG SACK is governed by the BIG SACK Privacy Policy [link].
14. JURISDICTION AND APPLICABLE LAW
14.1 These terms and conditions are governed by Swiss law, with the exception of private international law. The exclusive place of jurisdiction is in Lausanne (VD), Switzerland.
